Stay Up to Date on Unwinding Public Health Emergency

On January 30, 2023, the Biden Administration announced its intent to end the national emergency and public health emergency (PHE) declarations related to the COVID-19 pandemic on May 11, 2023. CMS is providing resources to help physicians, institutions, hospitals, and others prepare for the end of the PHE, some of which have been updated based on recent action by Congress.

These resources include provider-specific fact sheets for information about COVID-19 PHE waivers and flexibilities. These fact sheets include information about which waivers and flexibilities have already been terminated, have been made permanent, or will end at the end of the PHE:

The physician fact sheet contains information on telehealth, vaccines, monoclonal antibodies, diagnostic testing and reporting, antivirals, workforce, and “Stark Law” waivers.

To access any of the fact sheets above plus additional information on waivers and flexibilities, please see the CMS Coronavirus Waivers and Flexibilities webpage. CMS will continue to provide updates as the end of the PHE approaches and will post the most up to date information on its Current Emergencies webpage.
